EchoMP Persona & Likeness Policy

1. Purpose
This Persona & Likeness Policy explains the requirements, restrictions, responsibilities, and permissions associated with creating, operating, sharing, monetizing, or distributing AI Personas through EchoMP.
All users, creators, partners, affiliates, and customers must comply with this Policy.
This Policy supplements the EchoMP Terms of Service, Privacy Policy, and Acceptable Use Policy.
2. User Responsibility
Users are solely responsible for:
- the personas they create;
- the content they upload;
- the voices they use;
- the likenesses they use;
- the identities they reference;
- the outputs they distribute;
- compliance with applicable laws.
EchoMP does not verify ownership, authorization, consent, identity rights, likeness rights, publicity rights, or permissions associated with user-created personas.
3. Required Rights and Permissions
Before creating or using a persona, users must possess all necessary:
- permissions;
- licenses;
- authorizations;
- releases;
- consents;
- legal rights.
This requirement applies to:
- names;
- photographs;
- images;
- videos;
- voice samples;
- recordings;
- likenesses;
- identities;
- biographies;
- training materials;
- other uploaded content.
Users represent and warrant that they possess all necessary rights before using such materials through EchoMP.
4. Personal Personas
Users may create personas based upon themselves.
Users are responsible for ensuring:
- information provided is accurate;
- rights belong to them;
- content complies with applicable law;
- content complies with platform policies.
EchoMP may request verification where necessary.
5. Authorized Third-Party Personas
Users may create personas based upon another individual only where they possess all required permissions and authorizations.
Examples may include:
- employees;
- business representatives;
- trainers;
- consultants;
- instructors;
- spokespersons;
- family members;
- performers;
- clients.
Users must be able to demonstrate authorization if requested.
EchoMP may remove personas where authorization cannot be reasonably established.
6. Voice Usage Requirements
Users may upload, generate, synthesize, or clone voices only where they possess all required rights and permissions.
Users may not:
- clone voices without authorization;
- misappropriate voices;
- use voices unlawfully;
- violate contractual restrictions;
- violate publicity rights;
- violate privacy rights.
Users remain solely responsible for all claims relating to voice usage.
7. Image and Likeness Requirements
Users may upload or use photographs, videos, likenesses, avatars, images, or similar materials only where they possess all necessary rights and permissions.
Users may not:
- misappropriate likenesses;
- use unauthorized photographs;
- use unauthorized images;
- use unauthorized recordings;
- create deceptive likenesses;
- violate publicity rights.
EchoMP may remove likenesses or personas where concerns are raised regarding authorization.
8. Public Figures and Well-Known Individuals
Users may not create personas that falsely imply endorsement, sponsorship, authorization, employment, affiliation, or approval by a public figure, celebrity, government official, athlete, entertainer, business leader, or other well-known individual.
EchoMP may restrict, remove, suspend, or prohibit personas involving public figures where legal, regulatory, provider, reputational, operational, or safety concerns exist.
EchoMP reserves the right to determine whether a public-figure persona is appropriate for the platform.
9. Misrepresentation and Identity Abuse
Users may not create personas intended to:
- impersonate another person;
- deceive others regarding identity;
- facilitate fraud;
- facilitate scams;
- mislead consumers;
- create confusion regarding affiliation;
- create confusion regarding endorsement.
EchoMP may remove such personas immediately.
10. AI Disclosure Expectations
Users remain responsible for complying with applicable AI disclosure laws.
Where disclosure is required by applicable law, users must clearly disclose that interactions involve artificial intelligence, synthetic media, digital avatars, automated communications, or AI-generated content.
EchoMP may provide disclosure tools but does not guarantee legal compliance.
11. Featured Personas
From time to time, EchoMP may feature selected personas, creators, experiences, demonstrations, or content on the platform, website, marketing materials, social media, presentations, or other promotional materials.
Featured placement is discretionary and may be modified, restricted, suspended, or removed at any time.
Featured placement does not create:
- ownership rights;
- employment relationships;
- partnership rights;
- revenue guarantees;
- endorsement obligations;
- preferential treatment.
Separate permissions or releases may be required before certain personas are featured publicly.
12. Commercial and Monetized Personas
Users may create monetized personas only in accordance with:
- EchoMP Terms of Service;
- EchoMP Acceptable Use Policy;
- applicable laws;
- applicable provider requirements;
- applicable monetization program requirements.
Users remain solely responsible for:
- claims made by their personas;
- representations made by their personas;
- products or services promoted by their personas;
- regulatory compliance;
- disclosures required by law.
EchoMP does not guarantee revenue, earnings, referrals, engagement, traffic, customer demand, or commercial success.
13. Professional and Business Personas
Users creating personas for businesses, organizations, professionals, consultants, instructors, service providers, or commercial entities are responsible for ensuring that:
- representations are accurate;
- credentials are not misrepresented;
- required licenses are maintained;
- applicable regulations are followed;
- consumer protection requirements are satisfied.
EchoMP does not verify professional qualifications, certifications, licenses, or credentials.
14. Reporting Violations
Individuals may report concerns relating to:
- unauthorized personas;
- impersonation;
- unauthorized voice usage;
- unauthorized likeness usage;
- privacy violations;
- publicity rights concerns;
- copyright concerns;
- deceptive content;
- identity misuse;
- policy violations.
Reports should include sufficient information to permit investigation.
EchoMP may request additional information before taking action.
15. Takedown Requests
EchoMP may review requests relating to:
- unauthorized use of a person's identity;
- unauthorized voice usage;
- unauthorized likeness usage;
- impersonation concerns;
- publicity rights concerns;
- privacy concerns;
- legal claims.
Submission of a request does not guarantee removal.
EchoMP may request documentation, evidence, identity verification, proof of authority, or additional information before making a determination.
16. Investigations
EchoMP may investigate complaints, reports, claims, or concerns relating to personas.
During an investigation, EchoMP may:
- restrict access;
- suspend access;
- disable monetization;
- remove content;
- request information;
- request documentation;
- request proof of authorization.
Failure to cooperate with a reasonable investigation may result in enforcement action.
17. Persona Removal
EchoMP may remove, disable, suspend, restrict, archive, or permanently delete personas where EchoMP reasonably believes:
- authorization is lacking;
- rights are being violated;
- laws are being violated;
- policies are being violated;
- provider requirements are being violated;
- legal risk exists;
- regulatory risk exists;
- reputational risk exists;
- operational risk exists;
- safety concerns exist.
EchoMP is not obligated to provide advance notice prior to removal.
18. Provider Protection
EchoMP utilizes technology providers, infrastructure providers, payment providers, artificial intelligence providers, voice providers, avatar providers, and related service providers.
Users may not create or operate personas that jeopardize EchoMP's ability to maintain relationships with such providers.
EchoMP may remove personas or terminate accounts where provider-related concerns arise.
EchoMP's determination regarding provider protection and platform risk shall be final.
19. Repeat Violations
Users who repeatedly violate this Policy may be subject to escalating enforcement measures, including:
- warnings;
- content restrictions;
- monetization restrictions;
- earnings suspension;
- referral program removal;
- account suspension;
- permanent account termination.
EchoMP may consider prior violations when evaluating future enforcement actions.
20. Appeals
Where EchoMP elects to provide an appeal process, users may submit information for reconsideration.
Submission of an appeal does not guarantee reversal of a decision.
EchoMP reserves the right to uphold, modify, or reverse enforcement decisions in its sole discretion.
Decisions relating to platform safety, legal compliance, provider protection, impersonation, fraud prevention, and risk management may be treated as final.
21. Policy Updates
EchoMP may modify this Persona & Likeness Policy from time to time.
Updated versions may be published through the Services or through other reasonable means.
Continued use of the Services following publication of an updated Policy constitutes acceptance of the revised Policy to the extent permitted by law.
Users are responsible for reviewing the current version of the Policy.
